Validity of the sales contract, product and price information
The terms of sale apply when purchasing goods from the Online Store.
The prices of services sold in the Online Store are indicated next to the products. All prices of services sold in the Online Store are in euros.
Information about the service is presented directly next to the service in the Online Store.
Order placement
To order a service, a user must be created in the “mltreening” mobile application, after which a suitable package must be selected and the service must be paid for.
Note: when paying by bank link, be sure to click the “Return to merchant” button on the bank page.
Payments are mediated by Montonio Finance OÜ. Payment takes place outside the Online Store in a secure environment: for bank-link payments in the secure environment of the respective bank and for credit-card payments in the secure environment of Montonio Finance OÜ. The seller does not have access to the customer’s bank or credit-card data. The contract enters into force from the receipt of the amount due in the Online Store’s bank account.
The owner of the Online Store is the controller of personal data and forwards the personal data necessary for making payments to the authorized processor Montonio Finance OÜ.
If it is not possible to provide the ordered service due to the facility being closed for repair works or for another reason, the buyer will be notified as soon as possible and the amount paid, including delivery costs, will be refunded without delay, but no later than within 14 days from sending the notice.

Delivery
The service is offered only in the Gym premises. Gym passes are digital and are not physically delivered. To use the service and gain access to the gym, the “mltreening” mobile application must be used, where the service can be used on the basis of registration.
The service is available immediately after payment of the service fee.
Right of withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days.
The 14-day right of return does not apply to gym passes if the pass has already been used at least once.
The right of withdrawal does not apply if the buyer is a legal entity.
In order to use the 14-day right of return, the ordered goods may not be used in any way other than what is necessary to ascertain the nature, characteristics and functioning of the goods in the manner permitted for testing goods in a physical store.
If the goods have been used for a purpose other than what is necessary to ascertain the nature, characteristics and functioning of the goods, or if they show signs of use or wear, the Online Store has the right to reduce the refundable fee according to the decrease in the value of the goods.
To return the goods, a withdrawal statement must be submitted and sent to the email address info [at] mltreening.ee no later than within 14 days of receiving the goods.
The costs of returning the goods are borne by the buyer, except where the reason for the return is that the product to be returned does not correspond to what was ordered, for example a wrong or defective product.
The buyer must return the goods within 14 days following submission of the statement or provide proof that the goods were handed over to the carrier within that period.
Upon receipt of the returned goods, the Online Store refunds the buyer without delay, but no later than within 14 days from receipt of the withdrawal statement, all fees received from the buyer under the contract.
The Online Store may refuse to make refunds until it has received back the item that is the subject of the contract or until the buyer has provided proof that the item has been sent back, depending on which occurs earlier.
If the buyer has expressly chosen a delivery method different from the cheapest ordinary delivery method offered by the Online Store, the Online Store is not obliged to reimburse the cost exceeding the cost associated with the ordinary delivery method.
The Online Store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the online store has, due to an error, been marked significantly below the market price of the goods.
Right to submit a complaint
The Online Store is liable for non-conformity with the contract or a defect in the goods sold to the buyer that already existed at the time the item was handed over and that becomes apparent within up to two years from the handover of the goods to the buyer. During the first year from handover to the buyer, it is presumed that the defect already existed at the time of handover. Refuting that presumption is the responsibility of the Online Store.
When a defect appears, the buyer has the right to contact the online store no later than within two months by sending an email to info [at] mltreening.ee or by calling +37255623856.
The Online Store is not liable for defects that have arisen after the goods were handed over to the buyer.
If goods purchased from the Online Store have defects for which the Online Store is liable, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund the buyer all fees associated with the sales contract.
The Online Store responds to the consumer’s complaint in writing or in a form that can be reproduced in writing within 15 days.
Direct marketing and personal data processing
The Online Store uses the personal data entered by the buyer only for processing the order and sending the goods to the buyer. The Online Store forwards personal data to companies providing transport services for the purpose of delivering the goods.
The Online Store sends newsletters and offers to the buyer’s email address only if the buyer has expressed that wish by entering an email address on the website and has indicated a wish to receive direct marketing notifications.
The buyer can opt out at any time from offers and newsletters sent by email by notifying us by email or by following the instructions contained in the email with the offers.
Dispute resolution
If the buyer has complaints regarding the Online Store, they must be sent to the email address info [at] mltreening.ee or submitted by calling +37255623856.
If the buyer and the Online Store are unable to resolve the dispute by agreement, the buyer may contact the Consumer Disputes Commission. The procedural terms can be reviewed and an application submitted there. The Consumer Disputes Commission is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. Review of the buyer’s complaint by the commission is free of charge.
The buyer may turn to the European Union platform for resolving consumer disputes.
